RAW FILE POLICY, COPYRIGHT PROTECTION & ENFORCEMENT
King Thing Photography
1. COPYRIGHT OWNERSHIP
All photographs created by King Thing Photography, including but not limited to RAW files (digital negatives), edited JPEGs, previews, proofs, and derivative works, are the sole and exclusive intellectual property of King Thing Photography.
Copyright ownership remains with King Thing Photography at all times.
Booking photography services does not transfer copyright ownership under any circumstance.
2. RAW FILE POLICY – ZERO RELEASE
RAW files are proprietary, unfinished digital negatives and are not final products.
RAW files will not be:
• Delivered
• Sold
• Transferred
• Shared
• Duplicated
• Released
• Made available for purchase
There are no exceptions.
Payment for services does not create entitlement to RAW files.
3. LIMITED LICENSE – FINAL EDITED IMAGES ONLY
Clients receive a limited, non-exclusive, non-transferable personal-use license for final edited JPEG images only.
This license does not allow:
• Re-editing or altering images
• Applying filters, presets, overlays, or color adjustments
• Converting to black & white
• AI enhancement or manipulation
• Cropping or resizing in a way that removes watermark or branding
• Selling images
• Commercial use without written authorization
• Granting third-party usage rights
Images must remain in their delivered artistic form.
4. SOCIAL MEDIA ALTERATION CLAUSE
Images posted to social media platforms (including Instagram, Facebook, TikTok, Pinterest, etc.) may not be altered in any way.
The use of Instagram filters, preset overlays, AI tools, cropping that removes branding, color changes, or stylistic modifications is strictly prohibited.
Watermarks, if present, may not be removed, blurred, covered, or cropped out.
5. VENDOR & THIRD-PARTY USE POLICY
Clients may not provide images to vendors, venues, planners, publications, blogs, magazines, or other third parties for marketing or commercial use without prior written authorization from King Thing Photography.
Vendors may not:
• Crop out watermarks
• Remove branding
• Re-edit images
• Apply presets
• Claim authorship
• Use images for advertising without written permission
Separate licensing agreements may be required for vendor use.
6. LIQUIDATED DAMAGES
Unauthorized use, alteration, distribution, publication, or copyright violation will result in liquidated damages of:
$1,000 per image per violation
This amount reflects the minimum commercial licensing value and does not limit King Thing Photography’s right to pursue additional statutory damages under U.S. Copyright Law.
7. ENFORCEMENT
Unauthorized reproduction, modification, retention, or distribution constitutes copyright infringement under Title 17 of the United States Code.
King Thing Photography reserves the right to pursue:
• Statutory damages
• Actual damages
• Attorney fees
• Court costs
• Injunctive relief
• Formal cease-and-desist action
Screenshots, altered versions, AI modifications, and reposts without permission are considered infringement.
8. ACKNOWLEDGMENT
By booking services, signing a contract, or downloading images, the client acknowledges full understanding and agreement to these terms.
King Thing Photography reserves all rights not expressly granted.
